1. Purpose
These terms of use (the “Terms”) govern access to and use of the “Mon Auditorium” mobile application and website (the “Service”), a service for discovering, planning and personally archiving classical and operatic concerts.
Acceptance of the Terms is required and is given by ticking a box when creating an account. It also constitutes acceptance of the privacy policy.
This is a courtesy translation. In the event of any discrepancy, the French version prevails.
2. Access to the Service
The Service is available on iOS, on Android and through a browser. Most of the Service is free: the full catalogue, search, concert pages, ticket wallet, favourites and profile. Certain features belong to an optional paid subscription, “La Loge”, described in article 5.
The Service is available in French and English. That language is the language of the interface: programme content (concert titles, notes, biographies) comes from the musical institutions and remains in its original language.
Browsing without an account
The catalogue can be browsed without creating an account. To that end, the app opens an anonymous technical session on first launch, allowing you to browse and to use certain personal features on the device. That session is tied to no identity: it is lost if the app is uninstalled, if the device is reset, or if the token expires, and its content cannot be recovered. Creating an account is the only way to keep your data durably.
3. Creating and managing an account
You may create an account with an email address and a password, or through Google or Apple (Apple being offered on iOS). Accounts are reserved for people aged at least 16.
You are responsible for keeping your credentials confidential and for all activity carried out from your account. You undertake to provide accurate information and to keep it up to date.
If you create an account while browsing in an anonymous session, that session’s data is carried over to the new account. If you sign in to an existing account while browsing anonymously, a merge is performed; a subscription taken out under an anonymous session is not carried over by that merge — which is why subscribing is offered only to registered accounts.
4. The declarative nature of the ticket wallet
Mon Auditorium is not a box office. The Service neither sells, resells nor issues any ticket, and processes no payment for any performance. It lets you declare and organise tickets you have obtained elsewhere, from each hall’s official box office.
Important. The codes and QR codes displayed in the app are generated from the information you entered or scanned: they are reminders of your ticket, not means of admission. Should you have any difficulty at the door, only the original ticket (confirmation email, paper ticket, the hall’s own app) counts.
Box-office links lead to the institutions’ official platforms, over which Mon Auditorium exercises no control and from which it receives no commission. The terms of sale, exchange and refund are those of the hall concerned.
5. La Loge — paid subscription
“La Loge” is an optional subscription giving access to additional features of the Service. Using the Service without a subscription remains possible and free.
5.1 Composition
As of these Terms, La Loge includes in particular: unlimited watching of seat availability, display of the exact number of remaining seats per category, planning of the whole season (against a rolling thirty days without a subscription), exporting concerts to a calendar, and keeping the concert history with no time limit.
The make-up of La Loge, its features and their release schedule may change without notice. Some services depend on third parties (box offices, halls, operating-system vendors) and may be altered, suspended or withdrawn beyond our control. The subscription gives access to La Loge as it stands at the time, not to any particular feature. Benefits announced as “coming soon” are made available to members the day they go live, at no extra cost.
5.2 Nature of seat watching
Watching consists of periodically querying the hall’s public box office and notifying you when a release is detected. This is an obligation of means: Mon Auditorium guarantees neither the detection of every release, nor the availability of the seat when you read the notification, nor that you will obtain a ticket. Watching depends on the accessibility and format of the data each hall publishes; it is not offered for every concert, and the app states on the concert page whether it is open there.
5.3 Subscribing, price and payment
The subscription is taken out exclusively from within the app, and requires a registered account (an anonymous session cannot subscribe). The applicable price, currency and any promotional offers are those displayed in the app at the time of subscribing.
Payment is processed by Apple (App Store) or Google (Google Play), depending on the platform from which the app was downloaded, under their respective terms. Mon Auditorium neither collects, processes nor stores any payment card data.
5.4 Term, renewal and cancellation
The subscription runs for the period chosen (monthly or yearly) and renews automatically at the end of each period unless cancelled at least 24 hours before it ends. The amount is charged when the purchase is confirmed, and again at each renewal.
Managing and cancelling the subscription is done from your App Store or Google Play account, never from Mon Auditorium: we technically have no control over those operations. After cancellation, access to La Loge continues until the end of the period already paid for.
Deleting your Mon Auditorium account does not cancel your subscription. It is held by your App Store or Google Play account and would continue to be billed: cancel it with the platform first.
5.5 Right of withdrawal
The subscription concerns digital content supplied immediately. By subscribing you expressly request immediate performance of the service and acknowledge that you thereby lose your fourteen-day right of withdrawal, in accordance with article L.221-28 3° of the French Consumer Code.
Any refund request is a matter for the platform that processed the payment (Apple or Google) and its own terms. Mon Auditorium cannot issue any direct refund.
5.6 Free allowances
Registered accounts are given, without a subscription, a limited number of free uses of La Loge features — revealing the remaining seat count, and watching a concert. That number may change; the one that applies is shown in the app, at the moment of use. These free uses are reserved for registered accounts — an anonymous session does not qualify — and are counted per device as well as per account, so that they cannot be renewed by creating successive accounts. Their number may be adjusted.
6. Content you add
The information you provide (musical tastes, biography, profile picture) and the content you add (tickets, personal programme) are visible to you alone: the Service currently has no sharing between users and no public profile.
You undertake not to enter any unlawful, abusive, defamatory content or content infringing the rights of others, and to use the “Report” function in good faith.
7. Fair use of the Service
You undertake not to:
- systematically extract, copy or reuse all or a substantial part of the Service’s database, in particular by automated means;
- access the Service other than through the interfaces provided, nor circumvent usage limits, free allowances or subscription checks;
- disrupt the operation of the Service or of the box offices it links to, in particular through an abnormal volume of requests;
- resell, rent out or make available to third parties access to your account or your subscription.
8. Accuracy of the catalogue
Information about concerts, works, artists, composers and halls is consolidated from public and official sources, then completed and verified by us before publication.
It is provided for information. Mon Auditorium cannot be held liable for an error, a change of programme, a change of cast or a cancellation. It is for the user to check essential information directly with the hall or its box office before travelling. A “Report an error” button appears on every page.
9. Notifications
The Service may send you notifications: a reminder before a concert whose ticket you have imported, an availability alert for a watched concert, news about the programming of an artist or composer you follow, and messages concerning your account.
Sending notifications to your device requires your permission at operating-system level, which can be withdrawn at any time in its settings. The categories can be adjusted within the app.
10. Intellectual property
The Service, its visual identity, its architecture, its database and its trade marks are the exclusive property of the publisher (see the legal notice). No licence or right is granted to you other than a personal, non-commercial right to use the Service.
The names, images and logos of the institutions and artists mentioned remain the property of their respective owners.
11. Suspension and deletion of the account
You may delete your account at any time from Settings → Privacy & security, confirming by typing. This is irreversible and results in the deletion of your data under the conditions described in the privacy policy. It does not cancel a current subscription (see article 5.4).
Mon Auditorium reserves the right to suspend or delete an account in the event of a breach of these Terms, after informing the user save in cases of urgency or legal obligation.
12. Changes to the Service and to these Terms
Mon Auditorium may change, add or withdraw features at any time, in particular for technical or legal reasons or to improve the product.
These Terms may be updated. Any substantial change will be brought to users’ attention by email or by notification in the app. Continued use of the Service after that information constitutes acceptance.
13. Liability
Mon Auditorium uses reasonable means to ensure the availability and security of the Service, without guaranteeing uninterrupted availability: interruptions may occur for maintenance, technical incident or the act of a third party (host, box office, distribution platform).
Mon Auditorium cannot be held liable for indirect damage, nor for a ticket not obtained, a performance missed or a journey made in vain. Nothing in these Terms limits the rights the law affords consumers.
14. Governing law and disputes
These Terms are governed by French law.
Should any difficulty arise, please contact us first at contact at mon-auditorium.fr: most disagreements are settled that way.
Under articles L.611-1 et seq. of the French Consumer Code, a consumer may refer the matter free of charge to a consumer mediator with a view to an amicable settlement, after first attempting to resolve it directly with us by written complaint. The details of the competent mediator are provided on request at the address above.
Failing an amicable settlement, any dispute falls within the jurisdiction of the French courts, under the conditions provided by law.
